Policy in practice: Labour and financial services – post-Mansion House speech reflections

Following our part one episode on Labour’s approach to financial services, Head of Public Policy David Gauke is joined once again by Financial Services Regulation Partners Alexandra Green and Michael Sholem to reflect on the Chancellor’s Mansion House speech and the announcement of the Leeds Reforms.

They cover:

proposed changes to the Financial Ombudsman Service, including a 10-year time limit for complaints and revised interest rates;
updates to the Consumer Duty and continued support for targeted support initiatives;
potential reforms to the Senior Managers and Certification Regime (SMCR);
long-term asset funds (LTAFs) becoming ISA-eligible from April 2026; and
The Government’s ambition to make the UK the leading global hub for financial services by 2035.

While the reforms are not on the scale of a regulatory “Big Bang”, they reflect a shift in tone – with a stronger focus on growth, risk appetite and international competitiveness. The direction is evolutionary rather than radical, but the breadth of reform is significant.

Policy in practice: opportunities for private capital managers - the Mansion House Accord and the new Pension Schemes Bill

the commitment made by 17 of the UK's largest pension funds to invest 10% of their defined contribution default funds in private markets by 2030, with half being invested in the UK, and reactions from the pensions and investment sectors;
key regulatory, operational and cultural barriers, including the charge cap and permitted links; and
key measures introduced in the new Pension Schemes Bill and the Government’s ongoing drive to consolidate the defined contribution pension market.

Most contractual changes can be agreed between employer and employee, but this is not always the case. Forcing through a change can sometimes be necessary, either by unilaterally imposing the change or, more drastically, by dismissing those employees who refuse to accept the changed terms, and offering to re-employ them on the new terms. Employment lawyers call this dismissal and re-engagement. The press uses the snappier label “fire and re-hire”. This option of last resort has come under heavy criticism in recent months, particularly after the well-publicised P&O episode, with litigation reaching the Court of Appeal in at least one dispute. In March 2022 the Government committed to introducing a new statutory Code of Practice to give clearer guidance in this area. A draft Code has now been published, and we explore the draft in this month’s podcast.

The UK Government is taking renewed steps to “shake off” the continued legacy of EU law through the new Retained EU Law (Revocation and Reform) Bill. If enacted, the Bill will revoke EU-derived legislation by the end of 2023 using so-called “sunset provisions” and provide the government with wide powers to amend EU-derived laws subject only to limited parliamentary scrutiny.
